These Terms of Service govern the use of the Coastal Studio website at coastalstudio.au and describe the basis on which we provide our services. By engaging Coastal Studio, you agree to these terms.
Coastal Studio (ABN 67 102 250 913) is a web design and digital agency based in Karridale, Western Australia.
Our services
Coastal Studio provides web design, SEO, AI integration, POS system setup, booking platform configuration, brand identity, and digital strategy services to businesses primarily located in Western Australia.
Specific project deliverables, timelines, pricing and payment terms are set out in individual project proposals and agreements provided to clients prior to commencement. Those agreements form part of the contractual relationship between Coastal Studio and the client.
Quotes and pricing
All quotes are provided in Australian Dollars (AUD) inclusive of GST unless otherwise stated. Quotes are valid for 30 days from the date of issue. Prices on this website are indicative only and final pricing is confirmed in writing via a formal proposal.
Payment
Project payment terms are outlined in each individual proposal. Unless otherwise agreed in writing, projects require a deposit of 50% of the total project fee, payable within 7 days of signing the project agreement, before work commences. The remaining 50% is due within 7 days of project completion and delivery of final files or site launch, whichever comes first.
Ongoing retainer and Website-as-a-Service (WaaS) subscriptions are billed monthly in advance.
Late payments may incur interest at the rate of 2% per month on the outstanding balance. Coastal Studio reserves the right to suspend services or withhold deliverables where payments are outstanding.
Client responsibilities
Clients are responsible for:
- Providing accurate, timely feedback and content as required
- Ensuring they hold the rights to any content, images or materials provided to Coastal Studio for use in their project
- Keeping their login credentials, hosting accounts and domain registrations secure
- Reviewing and approving deliverables within agreed timeframes
Delays caused by late client feedback or content provision may affect project timelines and are not the responsibility of Coastal Studio.
Intellectual property
Full build clients: Upon receipt of full and final payment, ownership of the completed website design and all content created specifically for the client's project transfers to the client. Coastal Studio retains the right to display completed work in its portfolio.
Website-as-a-Service (WaaS) clients: Where a website is provided under a monthly WaaS subscription, the website — including its design, code, structure and all Coastal Studio-created content — remains the sole intellectual property of Coastal Studio at all times. The client is granted a non-exclusive, non-transferable licence to use the website for the duration of their active subscription. This licence does not constitute ownership. Upon cancellation or termination of the subscription for any reason, the licence is revoked and Coastal Studio reserves the right to take the website offline. No ownership rights transfer to the client under a WaaS arrangement, regardless of the duration of the subscription.
In both cases, third-party components (themes, plugins, stock images, fonts, or licensed software) remain subject to their respective licences. Coastal Studio retains ownership of any proprietary tools, code libraries or internal frameworks used in the delivery of services.
Confidentiality
Both parties agree to keep confidential any sensitive business information shared during the course of a project. This includes business strategies, pricing, customer data, and unpublished content. This obligation continues after the completion of any project.
Website use
The content on coastalstudio.au is provided for general information purposes. While we take care to keep information accurate and up to date, we make no warranties regarding the completeness or suitability of information on this site for any particular purpose.
You must not use this website in any way that causes, or may cause, damage to the website or impairs its availability, or in any way that is unlawful, fraudulent or harmful.
Limitation of liability
To the maximum extent permitted by Australian law, Coastal Studio's liability for any claim arising from our services is limited to the fees paid by the client for the specific services giving rise to the claim.
Coastal Studio is not liable for indirect, consequential or special loss, including loss of profit, loss of data, or business interruption, even if we have been advised of the possibility of such loss.
Use of AI and automated tools: Coastal Studio uses artificial intelligence tools, AI-assisted software and other automated programmes in the course of delivering services. These may include but are not limited to AI-generated content, AI-assisted code, copywriting tools, image generation software and automated optimisation tools. While we review and quality-check all AI-assisted output, these technologies can produce errors, inaccuracies or unexpected results. Coastal Studio accepts no liability for any loss, damage or adverse outcome arising from the use of AI or automated tools, whether used directly by Coastal Studio or incorporated into any deliverable. Clients are encouraged to review all content and output before publication.
Termination
Either party may terminate a project engagement with 14 days' written notice. On termination, the client is liable for payment of all work completed to the date of termination. Deposits are non-refundable once work has commenced.
Governing law
These terms are governed by the laws of Western Australia, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
Changes to these terms
We may update these Terms of Service from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of our website or services following any changes constitutes acceptance of the updated terms.
